Privacy Policy

Your privacy is important to us. It is Soleeva's policy to respect your privacy and comply with any applicable law and regulation regarding any personal information we may collect about you, including across our website, https://soleeva.com, and other sites we own and operate.

Personal information is any information about you which can be used to identify you. This includes information about you as a person (such as name, address, and date of birth), your devices, payment details, and even information about how you use a website or online service.

In the event our site contains links to third-party sites and services, please be aware that those sites and services have their own privacy policies. After following a link to any third-party content, you should read their posted privacy policy information about how they collect and use personal information. This Privacy Policy does not apply to any of your activities after you leave our site.

This policy is effective as of 30 June 2026.

We will notify you of material changes by updating the ‘Last updated’ date above and, where required by law or where changes materially affect your rights as a California resident, by posting a notice on our website or sending an email to the address on file. Continued use of the website after the effective date of a revision constitutes acknowledgment of the updated policy for non-California residents. California residents should review the ‘Additional Disclosures for California Compliance’ section for rights that cannot be waived by continued use.

Information We Collect

Information we collect falls into one of two categories: “voluntarily provided” information and “automatically collected” information.

“Voluntarily provided” information refers to any information you knowingly and actively provide us when using or participating in any of our services and promotions.

“Automatically collected” information refers to any information automatically sent by your devices in the course of accessing our products and services.

Log Data

When you visit our website, our servers may automatically log the standard data provided by your web browser. It may include your device’s Internet Protocol (IP) address, your browser type and version, the pages you visit, the time and date of your visit, the time spent on each page, and other details about your visit.

Additionally, if you encounter certain errors while using the site, we may automatically collect data about the error and the circumstances surrounding its occurrence. This data may include technical details about your device, what you were trying to do when the error happened, and other technical information relating to the problem. You may or may not receive notice of such errors, even in the moment they occur, that they have occurred, or what the nature of the error is.

Please be aware that while this information may not be personally identifying by itself, it may be possible to combine it with other data to personally identify individual persons.

In addition to server-generated log data, our website uses third-party scripts, pixels, tags, and software development kits that execute automatically in your browser when you load a page. These technologies cause your browser to transmit addressing and signaling information — including your IP address and device or browser identifiers — to third-party servers. This occurs as part of the ordinary page-load process and is separate from any information you actively submit to us.

We deploy a consent management platform (CMP) that presents you with a cookie consent banner on your first visit. Non-essential third-party tracking scripts — including those used for advertising and analytics — will not execute until you provide affirmative consent through that banner. For a complete list of the specific trackers active on soleeva.com, the data each collects, and your choices, please refer to our Cookie Policy, specifically the ‘Cookies and Trackers We Use’ section.

Device Data

When you visit our website or interact with our services, we may automatically collect data about your device, such as:

  • Device Type,
  • Operating System,
  • Unique device identifiers,
  • Device settings,
  • Geo-location data,
  • Advertising identifiers (e.g., Google Advertising ID),
  • Browser and device fingerprint signals (e.g., screen size, viewport, user-agent string, platform, language),
  • Session and event identifiers assigned by third-party analytics and advertising platforms.

These identifiers may constitute personal information under the CCPA/CPRA and are subject to the rights described in the ‘Additional Disclosures for California Compliance’ section.

Data we collect can depend on the individual settings of your device and software. We recommend checking the policies of your device manufacturer or software provider to learn what information they make available to us.

Personal Information

We may ask for personal information — for example, when you subscribe to our newsletter or when you contact us — which may include one or more of the following:

  • Name
  • Email
  • Date of birth
  • Phone/mobile number
  • Home/mailing address

‍

Legitimate Reasons for Processing Your Personal Information

We only collect and use your personal information when we have a legitimate reason for doing so. In which instance, we only collect personal information that is reasonably necessary to provide our services to you.

Collection and Use of Information

We may collect personal information from you when you do any of the following on our website:

  • Enter any of our competitions, contests, sweepstakes, and surveys
  • Sign up to receive updates from us via email or social media channels
  • Use a mobile device or web browser to access our content
  • Contact us via email, social media, or on any similar technologies
  • When you mention us on social media

We may collect, hold, use, and disclose information for the following purposes, and personal information will not be further processed in a manner that is incompatible with these purposes:

  • to provide you with our platform's core features and services
  • to deliver products and/or services to you
  • to contact and communicate with you
  • for analytics, market research, and business development, including to operate and improve our website, associated applications, and associated social media platforms
  • for advertising and marketing, including to send you promotional information about our products and services and information about third parties that we consider may be of interest to you
  • to consider your employment application
  • for internal record keeping and administrative purposes
  • to run competitions, sweepstakes, and/or offer additional benefits to you
  • to comply with our legal obligations and resolve any disputes that we may have
  • to attribute any content (e.g. posts and comments) you submit that we publish on our website
  • for security and fraud prevention, and to ensure that our sites and apps are safe, secure, and used in line with our Terms of Service
  • for technical assessment, including to operate and improve our app, associated applications, and associated social media platforms

We may combine voluntarily provided and automatically collected personal information with general information or research data we receive from other trusted sources. For example, Our marketing and market research activities may uncover data and insights, which we may combine with information about how visitors use our site to improve our site and your experience on it.

SMS, WhatsApp, and Email Communications and Consent

By affirmatively submitting your mobile phone number or email address through a form on our website — and checking the associated consent checkbox where provided — you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) to receive recurring automated or pre-recorded calls, text messages (SMS), and WhatsApp messages from Soleeva Energy, Inc. at the number you provide. These communications may include information about solar energy offers, home energy assessments, federal and state tax credit programs, battery storage options, and related updates relevant to your inquiry.

Effective January 27, 2025, your consent authorizes contact by Soleeva Energy, Inc. only and does not extend to any third-party solar companies, lead aggregators, or partners. Consent is not a condition of purchase. Message frequency may vary. Message and data rates may apply depending on your carrier or data plan.

SMS Opt-Out: You can opt out of SMS messages at any time by replying with the word STOP. For additional support, reply with HELP.

WhatsApp Opt-Out: You can opt out of WhatsApp messages by replying STOP in the chat, or by blocking the sender in your WhatsApp application. For assistance, please contact us at info@soleeva.com.

Email Opt-Out: Every promotional email we send includes an unsubscribe link at the bottom. You may click this link at any time to stop receiving future email communications. You may also request removal by contacting us at info@soleeva.com.

We record the time, date, form URL, and content of your consent submission and retain that record for a minimum of four years, as required to demonstrate compliance with the TCPA and FCC regulations. If you believe you received a communication from us without having provided valid consent, please contact us immediately at info@soleeva.com so we can investigate and correct our records.

We do not sell your phone number or email address to third parties for their own marketing purposes. In limited circumstances, we may share contact information with financing partners or installation subcontractors acting on our behalf solely to fulfill your solar estimate or installation request; such sharing is governed by written data-processing agreements and is not used for independent third-party marketing.

All commercial email messages sent by Soleeva Energy comply with the CAN-SPAM Act. Each commercial email will clearly identify itself as an advertisement where required, will include our physical mailing address (1918 Junction Ave, San Jose, CA 95131), and will provide a functional opt-out mechanism. We will honor opt-out requests within 10 business days of receipt. We do not use deceptive subject lines or misleading header information in our email communications.

Our marketing and transactional emails may contain tracking pixels that allow us to detect whether an email has been opened and whether links were clicked. This information is used solely to measure the effectiveness of our communications and to improve the relevance of future messages. We do not use email tracking to build behavioral profiles for sale to third parties. You may disable email tracking by configuring your email client to block remote images without affecting your ability to receive our messages. For additional detail on email tracking pixels, please refer to the ‘Email Tracking & CAN-SPAM’ section of our Cookie Policy.

Security of Your Personal Information

When we collect and process personal information, and while we retain this information, we will protect it within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use, or modification.

Although we will do our best to protect the personal information you provide to us, we advise that no method of electronic transmission or storage is 100% secure, and no one can guarantee absolute data security.

You are responsible for selecting any password and its overall security strength, ensuring the security of your own information within the bounds of our services. For example, ensuring you do not make your personal information publicly available via our platform.

How Long We Keep Your Personal Information

We keep your personal information only for as long as we need to. This time period may depend on what we are using your information for, in accordance with this privacy policy. For example, if you have provided us with personal information such as an email address when contacting us about a specific enquiry, we may retain this information for the duration of your enquiry remaining open as well as for our own records so we may effectively address similar enquiries in future. If your personal information is no longer required for this purpose, we will delete it or make it anonymous by removing all details that identify you.

However, if necessary, we may retain your personal information for our compliance with a legal, accounting, or reporting obligation or for archiving purposes in the public interest, scientific, or historical research purposes or statistical purposes.

Children’s Privacy

We do not aim any of our products or services directly at children under the age of 13, and we do not knowingly collect personal information about children under 13.

‍

We may disclose personal information to:

  • a parent, subsidiary, or affiliate of our company
  • third-party service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage, hosting and server providers, ad networks, analytics, error loggers, debt collectors, maintenance or problem-solving providers, advertising providers, professional advisors, and payment systems operators

International Transfers of Personal Information

The personal information we collect is stored and/or processed in the United States, or where we or our partners, affiliates, and third-party providers maintain facilities.

The countries to which we store, process, or transfer your personal information may not have the same data protection laws as the country in which you initially provided the information. If we transfer your personal information to third parties in other countries: (i) we will perform those transfers in accordance with the requirements of applicable law; and (ii) we will protect the transferred personal information in accordance with this privacy policy.

Your Rights and Controlling Your Personal Information

Your choice: By providing personal information to us, you understand we will collect, hold, use, and disclose your personal information in accordance with this privacy policy. You do not have to provide personal information to us, however, if you do not, it may affect your use of our website or the products and/or services offered on or through it.

Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this privacy policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

Marketing permission: If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us using the details below.

Access: You may request details of the personal information that we hold about you.

Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, please contact us using the details provided in this privacy policy. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading, or out of date.

Non-discrimination: We will not discriminate against you for exercising any of your rights over your personal information. Unless your personal information is required to provide you with a particular service or offer (for example providing user support), we will not deny you goods or services and/or charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties, or provide you with a different level or quality of goods or services.

Notification of data breaches: We will comply with laws applicable to us in respect of any data breach.

Complaints: If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. Unsubscribe: To unsubscribe from our email database or opt-out of communications (including marketing communications), please contact us using the details provided in this privacy policy, or opt-out using the opt-out facilities provided in the communication. We may need to request specific information from you to help us confirm your identity.

Use of Cookies

We use cookies and similar third-party tracking technologies to collect information about you and your activity across our site. A cookie is a small piece of data stored on your device that helps us understand how you use our site and enables advertising and analytics functions. Some of these technologies transmit addressing and signaling information — including your IP address and device identifiers — to third-party servers as an inherent part of how they operate.

When you first visit our website, a consent banner will invite you to accept or decline non-essential cookies. Non-essential tracking scripts will not execute until you provide affirmative consent.

For a full description of the cookies we use, the specific third-party trackers active on our site, your consent rights, and your opt-out options under the CCPA/CPRA, please refer to our Cookie Policy at soleeva.com/legal/cookie-policy.

‍

Live Chatbot

Our website features a live chatbot that you may use to ask questions, request a solar estimate, or get help with your inquiry. Before you begin a chat session, you are shown a consent notice stating that the chat is recorded and stored to help process your request, and that your conversation may be shared with trusted providers who operate the chatbot or support our services. The chatbot will not begin processing your conversation until you select “I agree” in response to that notice.

When you use the chatbot, we may collect the information you choose to share during the conversation, which can include your name, email address, phone number, mailing or property address, details about your home or energy usage relevant to a solar estimate, and the content of the messages you submit. We may also automatically collect technical information about your session, such as the time and date of the conversation, consistent with the Log Data and Device Data described in the “Information We Collect” section above.

We use chatbot conversation data to respond to your inquiry, generate or refine a solar estimate, schedule a consultation, route your inquiry to the appropriate team or partner, and maintain a record of your request for customer service and quality purposes. We do not use chatbot conversations to make automated decisions that produce legal or similarly significant effects without human review.

Chatbot conversations are stored and may be reviewed by Soleeva personnel for quality assurance, training, and customer service purposes. The chatbot is operated in part by a third-party chatbot or conversational AI service provider acting on Soleeva’s behalf under a written agreement that restricts that provider’s use of your conversation data to providing and improving the chatbot service for Soleeva and prohibits that provider from using your conversation data for its own independent marketing purposes.

If your chatbot conversation results in an estimate request or service inquiry that we route to a third-party solar provider partner for fulfillment, that disclosure is made on the same basis, and is subject to the same limitations, described in the “Disclosure of Personal Information to Third Parties” section of this Privacy Policy. We do not share your chatbot conversation transcript itself with solar provider partners; we share only the contact and project information necessary for them to follow up on your inquiry.

Your chatbot conversation data is retained in accordance with the “How Long We Keep Your Personal Information” section of this Privacy Policy. You may exercise your rights to access, delete, or correct chatbot conversation data in the same manner described in the “Your Rights and Controlling Your Personal Information” section, and California residents may exercise their rights as described in the “Additional Disclosures for California Compliance (US)” section.

For information about cookies or session-tracking technologies used to support chatbot functionality, please refer to our Cookie Policy. Use of the chatbot is also subject to our Terms of Service and Acceptable Use Policy, including the prohibition on submitting false or fraudulent information through any contact mechanism on this website.

Business Transfers

If we or our assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data, including your personal information, among the assets transferred to any parties who acquire us. You acknowledge that such transfers may occur, and that any parties who acquire us may, to the extent permitted by applicable law, continue to use your personal information according to this policy, which they will be required to assume as it is the basis for any ownership or use rights we have over such information.

Limits of Our Policy

Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and policies of those sites, and cannot accept responsibility or liability for their respective privacy practices.

Changes to This Policy

At our discretion, we may change our privacy policy to reflect updates to our business processes, current acceptable practices, or legislative or regulatory changes. If we decide to change this privacy policy, we will post the changes here at the same link by which you are accessing this privacy policy.

If required by law, we will get your permission or give you the opportunity to opt in to or opt out of, as applicable, any new uses of your personal information.

Additional Disclosures for California Compliance (US)

Under California Civil Code Section 1798.83, if you live in California and your business relationship with us is mainly for personal, family, or household purposes, you may ask us about the information we release to other organizations for their marketing purposes.

To make such a request, please contact us using the details provided in this privacy policy with “Request for California privacy information” in the subject line. You may make this type of request once every calendar year. We will email you a list of categories of personal information we revealed to other organisations for their marketing purposes in the last calendar year, along with their names and addresses. Not all personal information shared in this way is covered by Section 1798.83 of the California Civil Code.

Do Not Track

Some browsers transmit a ‘Do Not Track’ (DNT) signal. Because there is no universally accepted standard for interpreting DNT signals, our website does not currently alter its data collection practices in response to DNT signals alone.

However, we honor the Global Privacy Control (GPC) signal as a valid opt-out of the sale and sharing of your personal information, as required by the CPRA (Cal. Civ. Code § 1798.135(b)). If your browser or browser extension transmits a GPC signal when you visit soleeva.com, we will treat it as a request to opt out of the sale or sharing of your personal information and will suppress advertising and targeting cookies for that session. For more detail, please refer to the ‘Do Not Track & Global Privacy Control’ section of our Cookie Policy.

Cookies and Pixels

At all times, you may decline cookies from our site if your browser permits. Most browsers allow you to activate settings on your browser to refuse the setting of all or some cookies. Accordingly, your ability to limit cookies is based only on your browser’s capabilities. Please refer to the Cookies section of this privacy policy for more information.

CCPA-permitted financial incentives

In accordance with your right to non-discrimination, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels for the goods or services we provide.

Any CCPA-permitted financial incentive we offer will reasonably relate to the value of your personal information, and we will provide written terms that describe clearly the nature of such an offer. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

California Notice of Collection

In the past 12 months, we have collected the following categories of personal information enumerated in the California Consumer Privacy Act:

  • Identifiers, such as name, email address, phone number, account name, IP address, and an ID or number assigned to your account.
  • Customer records, such as billing and shipping address, and credit or debit card data.
  • Demographics, such as your age or gender. This category includes data that may qualify as protected classifications under other California or federal laws.
  • Internet activity, such as your interactions with our service.
  • Audio or visual data, such as photos or videos you share with us or post on the service.
  • Geolocation data.
  • Inferences, such as information about your interests, preferences and favorites.

Of the categories listed above, the following may be subject to the CPRA’s rules on sensitive personal information: precise geolocation data (if collected to a radius of 1,850 feet or less). We do not use precise geolocation for profiling without your separate opt-in consent. Cookie-derived identifiers, including advertising IDs and analytics client IDs assigned by Google, constitute ‘personal information’ under the CCPA/CPRA and are disclosed to and processed by Google LLC as described in our Cookie Policy. We do not knowingly sell or share the personal information of California residents under the age of 16.

For more information on information we collect, including the sources we receive information from, review the “Information We Collect” section. We collect and use these categories of personal information for the business purposes described in the “Collection and Use of Information” section, including to provide and manage our Service.

Right to Know and Delete

If you are a California resident, you have rights to delete your personal information we collected and know certain information about our data practices in the preceding 12 months. In particular, you have the right to request the following from us:

  • The categories of personal information we have collected about you;
  • The categories of sources from which the personal information was collected;
  • The categories of personal information about you we disclosed for a business purpose or sold;
  • The categories of third parties to whom the personal information was disclosed for a business purpose or sold;
  • The business or commercial purpose for collecting or selling the personal information; and
  • The specific pieces of personal information we have collected about you.

In addition to the rights listed above, the California Privacy Rights Act (CPRA) grants California residents the following additional rights, which became enforceable on January 1, 2023. You have the right to correct inaccurate personal information we hold about you. You have the right to opt out of the sale or sharing of your personal information, including sharing with advertising platforms for cross-context behavioral advertising purposes. You have the right to limit the use and disclosure of sensitive personal information to purposes specified in Cal. Civ. Code § 1798.121. You have the right to know the specific retention periods we apply to each category of personal information, or if that is not possible, the criteria used to determine those periods.

To exercise your right to opt out of the sale or sharing of your personal information, you may use the ‘Do Not Sell or Share My Personal Information’ link in our website footer, use our Cookie Preferences tool to disable advertising and targeting cookies, or submit a written request to info@soleeva.com. We will process opt-out requests within 15 business days. For cross-device opt-outs, you must submit a request on each device or browser you use.

We will respond to verified requests to know, delete, or correct within 45 calendar days of receipt. We may extend this period by an additional 45 days if reasonably necessary, in which case we will notify you of the extension and the reason within the initial 45-day period. We will not charge a fee for processing your request unless it is excessive, repetitive, or manifestly unfounded. To verify your identity before processing a request, we may ask you to provide information consistent with what we already have on file.

To exercise any of these rights, please contact us using the details provided in this Privacy Policy.

Shine the Light

If you are a California resident, in addition to the rights discussed above, you have the right to request information from us regarding the manner in which we share certain personal information as defined by California’s “Shine the Light” with third parties and affiliates for their own direct marketing purposes.

To receive this information, send a written request to: Soleeva Energy, Inc., Attn: Privacy Request, 1918 Junction Ave, San Jose, CA 95131, or email info@soleeva.com. Please include ‘Shine the Light Request’ in the subject line and provide your name, street address, city, state, and ZIP code. You may make one such request per calendar year. We will respond within 30 days. This disclosure is also described in the ‘California Shine the Light Disclosure’ section of our Cookie Policy.
